1. Acceptance of Terms
By accessing or using Taikai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email.
2. Description of Service
Taikai is a web-based karate tournament management platform that allows tournament organisers to create and manage competitions, and competitors to register, view draws, follow live scoreboards, and access results. The Service facilitates tournament entry fee payments through third-party payment providers (Stripe, PayPal).
3. Account Registration
To use certain features of the Service, you must create an account by providing your name, email address, and a password. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your password
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorised use of your account
You must be at least 16 years old to create an account. Parents or legal guardians may register children under 16 for tournaments through their own account.
4. Tournament Registration & Payments
When you register for a tournament through the Service:
- You agree to the tournament's specific terms, waivers, and conditions as set by the tournament organiser
- Entry fees are processed through third-party payment providers (Stripe, PayPal) and are subject to their terms of service
- Refund policies are determined by individual tournament organisers and are not controlled by Taikai
- Registration information you provide will be visible to the tournament organiser
5. User Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
You retain ownership of all personal data you enter into the Service. We do not claim any intellectual property rights over your content.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to the Service or its systems
- Interfere with or disrupt the Service's infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools (bots, scrapers) to access the Service
- Share your account credentials with others
- Create multiple accounts to circumvent any limitations
- Submit false registration information or fraudulent tournament entries
7. Tournament Organisers
If you use the Service to organise a tournament:
- You are responsible for the accuracy of tournament information (dates, venues, events, fees)
- You are responsible for handling competitor data in accordance with applicable privacy laws
- You are responsible for your tournament's refund and cancellation policies
- You agree not to use competitor data obtained through the Service for purposes unrelated to the tournament
8. Public Information
Certain information is displayed publicly as part of the Service's normal operation:
- Tournament details (name, date, venue, events, divisions)
- Draws (competitor names, dojo affiliations)
- Live scoreboard results
- Final results and placings
By registering for a tournament, you consent to this information being displayed publicly.
9. Account Deletion
You may request deletion of your account and all associated data at any time by contacting us. Upon deletion:
- All your personal data will be permanently removed
- Historical tournament results may be retained in anonymised form
- This action is irreversible
10. Service Availability
We strive to maintain the Service's availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service downtime.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Taikai is a tournament management tool and does not provide sporting, medical, or legal advice. Tournament organisers and competitors are solely responsible for ensuring compliance with relevant sporting body rules and regulations.
12. Limitation of Liability
To the maximum extent permitted by law, the trustee for The Phillips Family Trust and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or any damages arising from your use of the Service.
Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or AUD $50, whichever is greater.
13. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. We will make reasonable efforts to notify you before taking such action, except in cases of severe or repeated violations.
You may terminate your account at any time by requesting account deletion.
14. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time. If we make changes that materially reduce the functionality available to you, we will provide reasonable notice.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of the Service will be resolved through good-faith negotiation before pursuing other remedies.
